BREAKING NEWS - NEW ACCESS TO LEGAL ADVICE WHEN QUESTIONED BY THE POLICE AT THE STATION!
The Supreme Court will be handing down judgement on the 20th October 2010 in the case of HMA v Calder. Until now you have not had the right to have a lawyer present when questioned by the police at the police station. Until the judgement is available, the Lord Advocate has issued new guidelines. This means that if you are to be interviewed by the police as a suspect at a police station in a very serious case - homicide, attempted murder, any offence of serious violence, all sexual offences, road traffic fatalities and other very serious cases you can have access to a lawyer:
1. You will be asked to name a solicitor (a lawyer) to be contacted, and you will be told that you can speak with the solicitor BEFORE you are questioned by the police. If you don't know the name of a solicitor you can ask for the Duty Solicitor (solicitors sign up to take turns to do this and there is always one available)
2. if you say that you want to do this you will be able to see the lawyer in private before the police interview you. The police can only stop you from doing this if there is what is called a compelling reason why not - it can be complicated, but it is not likely to happen very often.
3. if you want your solicitor to be with you when you are questioned that will be okay for all but very unusual cases.
