What is expected of schools?

The key obligations, placed on local authorities and grant-assisted school managers, are:

  • To ensure that food and drink served in schools meets the nutritional requirements specified by Scottish Ministers in regulations (set out in depth in the Nutritional Requirements for Food and Drink in Schools (Scotland) Regulations 2008)
  • To encourage the uptake of school meals, especially among those eligible for free school meal
  • To protect the identity of those eligible for free school meals
  • To consider sustainable development guidance in the provision of food and drink in schools

The Act states that regard must be paid to any guidance issued by the Scottish Ministers in relation to how it should be implemented.Extensive guidance since published makes it explicit that publicly maintained schools are now expected to adopt measures to encourage and help children to be physically active, choose healthy food, and learn more about what being healthy means for them.
